Small Claims Court Is Not Simple Claims Court

The designation as the Small Claims Court, as opposed to the Simple Claims Court, stems from the recognition that legal proceedings involving amounts under $25,000 can be just as intricate, if not more so, than cases surpassing the $25,000 threshold set by the Small Claims Court.

Similarly to cases exceeding the $25,000 threshold addressed in higher courts, a Small Claims Court case entails both procedural and substantive law aspects. The procedural law, outlined in the Rules of the Small Claims Court, governs the process of a legal matter. Meanwhile, the substantive law, forming the basis of the dispute, encompasses various legal areas, including but not limited to contract law, tort law, employment law, consumer law, and construction law.
